Terms of Use & Sale

Childbyte Books Terms of Use and Sale

Effective date: September 23, 2026

These Terms govern purchases and use of childbytebooks.com and the Childbyte Books LLC writing and publishing program. “Childbyte,” “we,” and “us” mean Childbyte Books LLC. The adult accepting these Terms is responsible for the purchase or account. Our Privacy Policy explains how we handle personal information.

THESE TERMS REQUIRE THE USE OF ARBITRATION ON AN INDIVIDUAL BASIS TO RESOLVE DISPUTES, RATHER THAN JURY TRIALS OR CLASS ACTIONS.

1 Adults and young authors

Purchasers and account holders must be at least 18 and legally able to enter this agreement. The program portal is operated by the participating child’s parent or legal guardian, using that adult’s name and email address. The parent downloads program materials, reviews and submits all worksheets and files on the child’s behalf, handles communications, and approves the book for printing. The child completes the creative activities with parental guidance. Children must not independently operate accounts, submit materials, or message us through the portal. A gift purchaser who is not the parent or legal guardian cannot accept these responsibilities on that adult’s behalf.

Provide accurate account details, keep login credentials secure, and report suspected unauthorized access. Program access is for the parent-managed project of the enrolled author; sharing access outside that enrollment is not permitted.

2 Purchases and program access

The product description and checkout identify the services, book specifications, quantities, add-ons, price, taxes, and shipping charges included in your order. Use only authorized payment methods. Later price increases do not change accepted orders. If an error, availability issue, or suspected fraud prevents us from accepting an order, we will notify you and refund any payment for the canceled portion; we will not impose a higher price without agreement. Sales and shipping are limited to the United States.

Your purchase includes 12 months of program access beginning upon activation. For gifts, this period begins when the recipient activates the program. An unfinished project receives a 30-day grace period to complete and submit it or save copies of the work. A parent or legal guardian may request one complimentary 90-day extension before the grace period ends; the extension begins when the grace period ends. Additional services or quantities require a separate agreement and may involve additional charges.

We will email the adult account holder a reminder approximately 30 days before the initial deadline and a final reminder before project closure. Keep your account email current. After the applicable deadline, including any extension, we close unfinished projects and delete their files according to our Privacy Policy. Projects submitted on time still receive their included editing and printing, even if production finishes afterward.

Choosing not to participate or failing to finish by the applicable deadline does not, by itself, entitle you to a refund or credit. Included book production requires a completed submission within that deadline. This does not limit the 30-day cancellation rights in Section 5, remedies for our failure to provide purchased services or products, or rights provided by applicable law.

Gift purchases include only the items and access stated in the product description. Gifts may be redeemed using a gift card or coupon code through checkout and member registration. The recipient’s parent or legal guardian must register and manage the account and accept these Terms. Physical gift-package add-ons are separate from program completion and book production. We provide redemption instructions with the gift. Any redemption limits or lawful expiration must be disclosed before purchase; the program completion period begins upon recipient activation.

3 Ownership and service permissions

Authors retain ownership of their original stories, illustrations, and other original contributions. Submitting work does not transfer ownership to Childbyte. Our templates, teaching materials, branding, and other pre-existing resources remain ours or our licensors’; third-party materials remain subject to their licenses. You may use the resources supplied with your purchase for the enrolled author’s project, but may not resell or distribute the standalone program resources without permission.

You must have authority and permission to submit materials and authorize the requested services. You grant us a non-exclusive, royalty-free license to store, reproduce, format, edit within the purchased service, prepare a proof, and print and deliver the books you authorize. This includes processing through the production providers described in our Privacy Policy. The license is limited to providing those services and retaining files for the purposes and periods in that policy.

This license does not authorize advertising use of an author’s work or personal information, or public publication or sale of the book beyond the distribution you specifically request. Such uses require separate appropriate authorization. No likeness release or transfer of the author’s intellectual property is required by these Terms.

4 One proof and requested changes

We provide one proof before printing. The adult account holder must review the text, spelling, names, illustrations, and layout and either approve it or submit one consolidated set of requested changes within the purchased service’s scope.

Approving the proof or submitting requested changes authorizes printing once agreed changes are completed. We do not provide a second proof. If a requested change cannot be made within scope, we will explain the proposed alternative or charge and obtain your agreement before proceeding. Further requests after your proof response may not be possible.

To the extent permitted by law, we are not responsible for errors in the proof that you did not identify or errors in replacement wording or materials you supply. We remain responsible for implementing agreed changes accurately, errors we introduce afterward, manufacturing defects, and obligations that cannot lawfully be excluded.

5 Shipping cancellations and refunds

Shipping charges and available destinations are shown before purchase. Production estimates run from completion of the steps identified in the product description, including receipt of required materials and authorization to print. We will communicate qualifying delays and offer cancellation or refunds where required by law. Title and risk of loss pass on delivery.

Program cancellations: You may request a full refund of the program price within 30 days of purchase, provided the book has not been sent to print. Refund eligibility ends when the book is sent to print, even if fewer than 30 days have passed. For a gift activated through a separate recipient email address and registration, the 30-day period begins when the recipient activates the program. No deduction is made for program work already performed during an eligible cancellation. Program access ends when the cancellation is processed, and refunds are issued to the original purchaser’s payment method. Contact us through our website to request cancellation.

Physical products: Physical gift packages and printed books are not eligible for change-of-mind returns or exchanges. A separately priced physical gift package is excluded from a program refund. The remedies below still apply to damaged, defective, or incorrect products.

Product problems: Please report damaged, defective, or incorrect products through our website contact form within 30 days of delivery, with your order number, a description of the problem, and photographs where reasonably possible. For confirmed shipping damage, printing defects, incorrect items, or production errors caused by us, we will provide a replacement at no charge, ordinarily without requiring the item to be returned. If we require a return, we will provide instructions and cover return shipping. We will provide an appropriate refund if we cannot reasonably resolve the problem, or where required by law.

We do not provide complimentary replacements for errors the customer missed in the proof or supplied in replacement materials, provided we printed the proof accurately and implemented agreed changes correctly. These policies and the 30-day reporting request do not limit rights or remedies under applicable law. If we cancel services we cannot provide, we will refund the unprovided portion as required by law.

6 Appropriate use and uploads

These rules cover stories, images, files, links, messages, and all other submissions. Do not submit illegal, sexually explicit, exploitative, threatening, hateful, harassing, defamatory, or age-inappropriate material, including graphic violence or content encouraging self-harm. Age-appropriate creative work about difficult topics is not automatically prohibited.

Do not infringe intellectual property or privacy rights, expose another person’s private information without authorization, impersonate anyone, provide false consent, solicit children’s personal information, or engage in inappropriate contact with minors. Do not upload malware or harmful links, access accounts without permission, bypass security, scrape personal information, send spam, disrupt services, or exploit enrollment errors or gift and discount codes.

You are responsible for your submissions. Parents and legal guardians must oversee the enrolled child’s participation and help the child follow these rules. We may request changes, refuse to print, remove material, or restrict or terminate access when reasonably necessary to address violations, fraud, legal obligations, or safety and security risks. Urgent action may occur without advance notice. Contact us to request review of an enforcement decision. Refunds remain subject to Section 5 and applicable law.

We do not promise to review every interaction or upload before it becomes available. We may investigate reports and preserve or disclose information as required or permitted by law and consistent with our Privacy Policy. This does not limit our legal duties.

7 Copyright concerns

Report suspected copyright infringement through our website contact form, identifying the copyrighted work, the disputed material and its location, your contact details, and your authority to act. We respond as required by law and may terminate repeat infringers in appropriate circumstances.

8 Service expectations and liability

We may use Canva, ChatGPT Business, and Grammarly to assist with editing, formatting, and production. User-provided illustrations may be altered manually or with Canva’s AI tools where needed. The proof process gives the adult account holder an opportunity to review the proposed book before printing. We do not guarantee a particular learning result, commercial success, or that every element of the finished book qualifies for copyright protection. Keep your own copies of original work. We use reasonable efforts to operate the service but cannot guarantee uninterrupted or error-free website access. Using outside providers does not remove our own legal obligations.

To the extent permitted by law, the website is provided as available without implied warranties of merchantability, fitness for a particular purpose, or noninfringement. This does not override express promises about purchased services or required remedies for defective goods.

To the extent permitted by law, Childbyte is not liable for indirect, consequential, special, or punitive damages, or lost profits, arising from these Terms or the services. Our total liability for claims relating to a purchase is limited to the amount paid for the affected products or services. These limits do not apply to fraud, willful misconduct, gross negligence, or liabilities and consumer rights that cannot lawfully be limited.

To the extent permitted by law, the adult accepting these Terms agrees to reimburse Childbyte for reasonable losses and legal expenses from third-party claims caused by that adult’s unlawful conduct, material breach of these Terms, or submission of material without necessary rights. This does not cover losses caused by Childbyte’s own misconduct or breach. We will give prompt notice and a reasonable opportunity to participate in the defense and will not agree to a settlement imposing obligations on you without your consent.

9 Disputes and general terms

Florida law governs these Terms, subject to applicable federal law and mandatory protections available where you live. Before starting arbitration, contact write@childbytebooks.com with your name, order details, a description of the dispute, and the resolution requested. We will work with you in good faith for 30 days after receiving the notice to try to reach agreement. If the dispute remains unresolved, the purchase-dispute arbitration provisions below apply. This informal process does not prevent action needed to preserve a filing deadline or rights that cannot lawfully be restricted. In the provisions below, “Site” means childbytebooks.com.

YOU AND CHILDBYTE BOOKS, LLC ARE AGREEING TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.

ANY CLAIM, DISPUTE, OR CONTROVERSY (WHETHER IN CONTRACT, TORT, OR OTHERWISE, WHETHER PRE-EXISTING, PRESENT, OR FUTURE, AND INCLUDING STATUTORY, CONSUMER PROTECTION, COMMON LAW, INTENTIONAL TORT, INJUNCTIVE AND EQUITABLE CLAIMS) BETWEEN YOU AND US ARISING FROM OR RELATING IN ANY WAY TO YOUR PURCHASE OF PRODUCTS OR SERVICES THROUGH THE SITE, WILL BE RESOLVED EXCLUSIVELY AND FINALLY BY BINDING ARBITRATION.

The arbitration will be administered by the American Arbitration Association ("AAA") in Orange County Florida in accordance with the Consumer Arbitration Rules (the "AAA Rules") then in effect, except as modified by this Section. (The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this section.

The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction.

You agree to an arbitration on an individual basis. In any dispute, NEITHER YOU NOR CHILDBYTE BOOKS, LLC WILL BE ENTITLED TO JOIN OR CONSOLIDATE CLAIMS BY OR AGAINST OTHER CUSTOMERS IN COURT OR ARBITRATION OR OTHERWISE PARTICIPATE IN ANY CLAIM AS A CLASS REPRESENTATIVE, CLASS MEMBER OR IN A PRIVATE ATTORNEY GENERAL CAPACITY. The arbitral tribunal may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction.

If any provision of this arbitration agreement is found unenforceable, the unenforceable provision will be severed, and the remaining arbitration terms will be enforced.

Neither party is responsible for delays caused by events beyond reasonable control, but required notices, refunds, and other non-excludable obligations still apply. Failure to enforce a term is not a waiver; an unenforceable provision will be limited or removed while the rest remains effective to the extent permitted by law.

These Terms and the purchase details accepted at checkout form the agreement for the purchase. Later website changes will not retroactively reduce purchased services without agreement. We will date revisions, give notice of material changes, and obtain renewed agreement or consent where required. Formal notices may be sent to the contact details below; we may contact you at the email associated with your account or order.
